Original Video Discovery Order
LADY CAPULET and JULIET CAPULET, THE CITY OF VERONA,
MOTAGUE,, BENVOLIO, & MERCUTIO Defendants City of Verona, Benvolio and Mercutio, by their attorney's Corporation Council for the City of Verona (Friar Lawrence, Esq.) having requested a discovery conference with this Court, and plaintiffs, by their attorneys, Escalas and Paris (Gregory Sampson, Esq.) having consented to their request for a discovery conference; and Said conference having been held with Magistrate Judge Balthasar W. Smith on October 19, 1605; and Whereas, defendant City of Verona is in possession of an original video taping made at the City of Verona Jail by surveillance cameras on the 27th day of December, 1604, said tapes having been preserved by order of this Court dated the 9th day of February, 1605; and Whereas, defendant City of Verona has, by counsel, stated
that it has retained the original videotape in accordance with the Courts prior
order, and ORDERED, that upon completion of the testing, analysis, reproduction and review of the original videotape by TREC, said original videotape shall be deposited in an evidence bag, sealed, and sent by overnight mail to: Corporation Counsel of the City of Verona, City Hall, Room 123, Verona 56789; and it is further ORDERED, that the original videotape shall thereafter be returned to the possession of the City of Verona Corporation Counsel pursuant to the Court's pre-action order dated the 9th day of February, 1605 and held pursuant to the terms of that order; and it further ORDERED, that prior to mailing the original videotape by the City of Verona to TREC, defendant City of Verona is authorized and permitted to deliver the tape to an expert it selects for reproduction of the videotape and retention of a copy thereof in the City's possession.
